You know darn well that even if people don't HAVE to be in the bathroom for 48 minutes a day, they will be just because they can. It's like when a company gives people a set number of sick days, so people use them as vacation if they aren't sick.
The company isn't giving them 48 minutes; that's what the company's study found they are taking. Are you suggesting that companies should give people a set number of "bathroom days"? ("Boss, here is my signed request form for 0.007 bathroom days that I would like to take this afternoon.")
